TUE

Some athletes may have illnesses or conditions that require them to take medication or undergo procedures. If the medication or method that an athlete is required to use to treat a disease or medical condition is prohibited under the World Anti-Doping Agency (WADA) Prohibited List, a TUE may give that athlete permission to use that substance or method during competition without invoking an anti-doping rule violation (ADRV) and applicable sanction. TUE applications are evaluated by a panel of physicians, the TUE Committee (TUEC). TUEs from national anti-doping organizations (NADOs) are only valid for national-level competition and out-of-competition testing.

WHAT ARE THE CRITERIA FOR GRANTING AN AUT?

All four of the following criteria must be met (for more information, please refer toarticle 4.2 of WADA’s International Standard for Therapeutic Use Exemptions (ISTUE)):

Athletes subject to anti-doping rules need a TUE to use a prohibited substance or prohibited method. You should contact ORAD North Africa to find out who to send the application to and whether it is possible to apply for a retroactive TUE.

First of all, check whether the drug or method you intend to take or use is prohibited according to the WADA Prohibited List (you can check online at
globaldro.com
).

It is your responsibility to inform your doctor that you are an athlete subject to anti-doping rules. You and your doctor must check whether the substance or method prescribed is on the Prohibited List. If so, consider options that are not prohibited; if there are none, submit a TUE application. Remember that, ultimately, this is the responsibility of the athletes. Contact ORAD North Africa in case of difficulties.

Then contact ORAD North Africa to determine your level of competition and TUE application requirements.

If you are determined to be a national-level athlete (refer to the definition below for Libya and Mauritania) you must submit your TUE application to ORAD North Africa] in advance, as soon as the need arises, unless there is an emergency or exceptional circumstances.

For substances prohibited only in competition, you must apply for a TUE at least 30 days before your next competition. Please see “How to apply for a TUE from ORAD North Africa” below.

If your level is below the national level as defined above, you have the right to apply for a retroactive TUE after being tested by ORAD North Africa or any other anti-doping organization (ADO).

Important note:

A TUE granted by ORAD North Africa is only valid nationally. If you are or become an international-level athlete or take part in a major sporting event, this TUE will not be valid unless it has been recognized by the relevant International Federation (IF) or Major Event Organizer (M.E.O.). It is your responsibility to check whether your ORAD North Africa TUE is automatically recognized by this IF or GMO.

CAN I GET A RETROACTIVE AUT?

You can apply for a retroactive TUE from ORAD North Africa only in the following cases:

In rare and exceptional cases, and notwithstanding any other provision of the SIAUT, you may apply for and obtain retroactive approval for the therapeutic use of a prohibited substance or method if, given the purpose of the Code, it would be manifestly unfair if the retroactive TUE were not granted.

This one-off retroactive TUE will only be granted with the prior approval of WADA (and WADA may, at its own discretion, accept or reject ORAD North Africa’s decision).

Important note:

The use of a prohibited substance or method without a TUE could result in a VRAD.

If a retroactive TUE application is required following sample collection, we strongly advise you to prepare a medical file to submit for evaluation.

TUE application process

There are two ways to request your TUE. The most recommended is via the ADAMS system, using your user name and password. If you don’t have them, you can request them from afriquedunord@africa.rado-orad.org.
